The University of Sharjah Completes the Defense for the First Two Masters and PhD Theses in the College of Law Using Online Communication Technologies
The University of Sharjah held the first two master's and PhD theses defense using remote communication technology. This within the framework of the precautionary measures taken by the administration of the University of Sharjah due to the spread of the Coronavirus (COVID-19), and in the interest of the University to provide the opportunity for graduate students to complete their graduation requirements within the specified time. Prof. Hamid M.K. Al Naimiy, Chancellor of the University, was keen to follow the proceedings of the discussion sessions through the "Microsoft Team" program, and welcomed the members of the examination and supervision committees, and thanked them for their efforts and cooperation in remote communication using modern technologies to ensure the completion of graduation requirements for graduate students on time. He also congratulated the researchers in advance, wishing them success and happiness, stressing the importance of everyone coming together in facing the current conditions through the use of modern technologies, which the University is always keen on providing from major international companies while providing continuous technical support. At the end of the discussion, the University Chancellor expressed his happiness at the success of the researchers and the acceptance of their PhD and master's theses. He pointed out that this achievement will be added to the University's records in accomplishing its research and teaching tasks under these exceptional circumstances.
The researcher Hamda Alblooshi received from the College of Law a PhD in Public Law for her thesis submitted entitled "Disciplinary System in the UAE from the Perspective of Fair Trial Standards". The discussion and examination committee of the defense conducted through the application of Microsoft Teams included Prof. Magdi Shuaib, Public Law Professor at the College of Law at the UAE University and Chairman of the Committee and the External Examiner; Prof. Sam Dallah, Professor of Public Law at the College of Law at the University of Sharjah and the supervisor of the thesis; Dr. Ahsan Rabhi, Associate Professor of Public Law at the College of Law at the University of Sharjah and the internal examiner; and Dr. Essam Saeed, Associate Professor of Public Law at the College of Law at the University of Sharjah. The study aimed to identify the disciplinary system and the legitimacy of the previous and subsequent procedures for signing the disciplinary penalty in light of the human resources law in the federal government and the local laws and guarantees achieved by the employee to ensure justice and transparency. This in addition to the extent of compatibility between the effectiveness of management and disciplinary guarantees in order to achieve the progress of administrative work in a fair and orderly manner. The study reached a number of results, including that the United Arab Emirates was able to approve an integrated legal system to maintain the functioning of the public facility and achieve a balance between the public interest and the interest of the employee, through a disciplinary system aimed at maintaining the highest levels of job stability, which is based on the employee and works on a balance between the employee performing his job duties with the required capacity and adequacy and the job requirements. At the end of the defense, the committee recommended accepting the thesis and granting the researcher a PhD degree in public law.
The master's thesis submitted by researcher Alyan Al-Ajmi from the Department of Private Law, which was discussed remotely while he resided in the State of Kuwait using the Microsoft Teams application. His thesis was titled "Privacy Arbitration in Disputes Arising from Dealing in Securities". The discussion and examination committee consisted of Prof. Imad Eldin Abdul Hay, Acting Dean of the College of Law, University of Sharjah and Chairman of the Committee; Prof. Murad Al-Mawajdeh, Professor of Commercial Law at Dubai Police Academy and the external examiner; and the supervisor of the thesis Dr. Muzaffar Al-Rawi, Associate Professor of Commercial Law at the University of Sharjah; and the internal examiner Dr. Alaa Al-Nuaimi, Associate Professor of Commercial Law at the University of Sharjah. The study aimed to shed light on the disputes that may arise as a result of dealing in the stock market and to clarify the procedures and mechanisms for the arbitration process in this type of disputes by explaining the procedural rules regulating this type of arbitration. It reached a number of results, including that the Emirati legislator made resorting to arbitration optional after it was compulsory through the decision of the Chairman of the Board of Directors of the Securities and Commodities Authority for the year 2008, in addition to the fact that the legal nature of the arbitration system in securities disputes is not purely judicial and not contractual, but rather one of the types of state jurisdiction. At the end of the discussion, the committee recommended accepting the thesis and granting the researcher a master's degree in private law.
The defense of the two these was also followed by Prof. Raafat El-Awady, Dean of the College of Graduate Studies; Dr. Ali Bou Nassif, Assistant Dean of Academic Graduate Affairs, and a number of faculty members at the College of Law at the University of Sharjah.
